Stem cell therapy is one of the most promising advancements in modern medicine. It is being hailed for its ability to regenerate tissues, reduce inflammation, and tackle medical conditions that were once thought untreatable.

But as exciting as it sounds, navigating the legal status—especially in the US—can be tricky. Patients are often left wondering whether these breakthrough treatments are even allowed. In this article, we'll untangle US regulations and look at other countries where you can find safe, legal stem cell treatments.

  7. Key Takeaways

Are Stem Cells Legal in the US?

Short answer: Partly. Only certain stem cell therapies, like those for blood disorders, are FDA-approved and legal. Most treatments haven't yet passed the necessary approval process.

FDA's role in stem cell regulation

The Food and Drug Administration (FDA) regulates the safety and effectiveness of medical treatments, including regenerative medicine. These treatments must undergo clinical trials and receive FDA approval to be legal. This ensures they meet safety and efficacy standards before being offered to the general public.

What are the FDA-approved stem cell therapies?

As of December 2024, only 3 stem cell therapies have received full FDA approval:

  • Ryoncil - the first mesenchymal stromal cell therapy approved December 18, 2024 for treating steroid-refractory acute graft-versus-host disease in pediatric patients
  • Lyfgenia for sickle cell disease - showing 88% complete resolution of vaso-occlusive events between 6–18 months post-treatment
  • Hematopoietic stem cell transplantation (HSCT) - using stem cells from umbilical cord blood to treat certain cancers and blood disorders like leukemia

Despite limited FDA approvals, there's significant hope on the horizon. 115 global clinical trials involving 83 distinct pluripotent stem cell-derived products are currently active as of December 2024, targeting conditions in ophthalmology, neurology, and oncology. Additionally, over 5,000 registered clinical trials in the US are gathering proof of the therapy's safety and effectiveness.

To stay informed about FDA guidelines and approved treatments, visit the FDA website at www.fda.gov.

Limitations of stem cell therapy in the US

Despite FDA regulations, almost 3,000 clinics in the US offer unproven therapies for a wide range of medical conditions, while Bookimed partners with verified clinics meeting strict safety standardsї. These unregulated clinics try to bypass FDA regulations by:

  • Labeling treatments as "experimental". Some clinics market their treatments as part of ongoing research. However, it may lack proper oversight or adherence to safety protocols.
  • Using patient-funded trials. Some clinics offer treatments through so-called clinical trials where patients pay for the therapy, blurring the line between research and commercial services.
  • Operating under state-level laws. Some clinics take advantage of less stringent state regulations, allowing them to offer treatments that wouldn't pass under federal FDA guidelines.
  • Offering reduced dosages. Some clinics use reduced dosages of stem cells to circumvent FDA regulations, claiming their treatments are not technically "stem cell products."

While these methods enable clinics to offer unapproved treatments, choosing one of these clinics may come with real risks:

  • Safety concerns. A key issue with unapproved therapies is the lack of quality control. Without FDA oversight, there is no guarantee that the stem cells are being correctly handled and processed. Some clinics may use stem cells from unproven sources, which could be less effective or even harmful.
  • Ineffective dosages. Some clinics lower the amount of stem cells used in treatments to avoid FDA oversight. However, research shows that higher dosages often produce better results. Reduced doses may not be effective enough to repair or regenerate damaged tissue properly.

Stem cell research and clinical trials in the US

Stem cell research and clinical trials showing promising results

The lack of FDA approval for many treatments doesn't mean they're not considered effective by U.S. scientists. In fact, numerous FDA-approved clinical trials have shown that these therapies are safe and effective in multiple application areas, such as orthopedic, neurological, and heart conditions.

However, FDA approval is required to ensure that treatments in the US undergo rigorous testing before being marketed. This ensures that the therapies meet safety standards, are properly regulated, and provide reliable outcomes for patients.

Where Is Stem Cell Therapy Legal?

Regenerative medicine is gaining traction worldwide, but the legal landscape varies significantly from one country to another. While the US has strict regulations, some nations have embraced these treatments more fully. Here's a quick overview of the most prominent destinations for legal stem cell treatment:

North and South America

Mexico

Mexico's regulatory framework for these therapies is more flexible than in the US. It allows clinics to offer treatments that are still in clinical trials elsewhere. The Federal Commission for Protection against Sanitary Risks (COFEPRIS) allows treatments in regenerative medicine, including orthopedic and neurological conditions.

However, obtaining a COFEPRIS license for this therapy takes work. The clinic must provide extensive documentation to prove its safety and compliance with regulations regarding the facility, equipment, procedures, and medical staff training.

To conduct the therapy, clinics need to obtain specific licenses, such as:

  • Stem Cell Collection License (for harvesting mesenchymal stem cells);
  • Surgery Room License (for performing procedures);
  • Regenerative Medicine License (to legally offer treatments).

These licenses ensure clinics meet strict standards for safety, equipment, and medical expertise.

Leading COFEPRIS-approved clinics include Juventa Regenerative Medicine (5.0/5, Playa del Carmen), Giostar Stem Cell Therapy (5.0/5, Cancún), and Immunotherapy Regenerative Medicine (5.0/5, Puerto Vallarta) - all verified through Bookimed's quality assessment.

Mexico's reputation for excellence is reflected in patient experiences. One patient from the United States who received treatment at Juventa Regenerative Medicine shared: "Dr. Isabella Bernaschina was very interested in truly helping me. She was very efficient and she has considerable experience in the use of stem cells for many different conditions. She followed up after treatment to see how I was feeling and seemed to sincerely care about how I felt after treatment." (Bookimed verified review)

Colombia

Colombia's National Institute of Food and Drug Monitoring (INVIMA) governs the regulation of these therapies. Several laws and decrees ensure that stem cell collection, storage, and clinical use meet high safety and ethical standards. Before conducting any treatment, clinics should rigorously test stem cells for diseases and disease agents.

Middle East

Turkey

Regenerative medicine in Turkey is regulated by the Turkish Ministry of Health. Additionally, the Turkish Academy of Sciences and TÜBA Stem Cell Work Group support research in the country. The group also organizes conferences, symposiums, and research projects to foster collaboration between national and international scientists.

Turkey's leading Ministry of Health licensed clinics include Memorial Şişli Hospital (4.7/5, Istanbul) and Liv Hospital Ulus (4.5/5, Istanbul) - verified through Bookimed's comprehensive clinic assessment.

Turkey's reputation for excellence is reflected in patient experiences. One patient from Germany who received treatment at Liv Hospital Ulus shared: "Professor Erdal Karaöz demonstrates top professional competence, experience, versatility, seriousness and integrity. The clinic can keep up with the best in the world. A great treatment, I will repeat this in December with my wife." (Bookimed verified review)

Hello, my name is Vladislav Ivanov, Ukraine, Odessa city. In February 2021, my daughter Vlada was diagnosed with anaplastic ependymoma, we went to the doctors for a week trying to find out why the child started having severe headaches. They went through examinations, did an MRI, and as a fact, they found a brain tumor. That's when the ground slipped from under my feet. Realization has come - this has already happened, which means you need to quickly take action. The first thing we did was go to the children's hospital in Kyiv, the child was given a shunt. But unfortunately, fluid began to collect in my head and my vision began to fall sharply. The doctors explained that an operation was urgently needed. We did not have a large accumulated amount, and we decided to complete the operation abroad. We contacted Bookmed. We contacted the employee Marina. Marina quickly found a clinic for us in Turkey, organized a trip for us, flew to Turkey in a matter of days. The hospital was already waiting for us. Examined, took blood for tests and the next day an operation was scheduled. Everything went well. Then they underwent a course of radiotherapy. The results are positive, we were sent home to Ukraine (August 2021). Every 3 months they underwent MRI, the pictures were good .. But a year later, in March 2022, we heard the terrible words “relapse”, “war”. Hastily collected the necessary documents and left for Lviv. From there, by large buses, all children with cancer began to be taken out along the humanitarian corridor from Ukraine to Europe. The daughter and his wife were assigned to France. A second operation was performed, the tumor was removed, and after that a course of chemotherapy was prescribed. After a month of taking the course, the doctor said that chemotherapy was not helping. The doctor suggested experimental chemotherapy, but that didn't help either. As a result, the daughter is getting worse and worse every day. The child began to walk badly, the right leg and handle practically do not work. The child melted before my eyes. It's all very scary, but it's worse to leave Vlad without an opportunity for treatment. I again turned to Marina Bookmed Marina again very quickly found us a hospital in Turkey, helped us with the flight Paris Istanbul. Arrived at the hospital 2 days later, the operation was successful!!! After the operation, the child began to talk, swallow, and after a couple of days to walk. What I want to say Bookmed in particular Marina Provided us with moral support documentary for the second time at the highest level. Marina many thanks to you and your team THANK YOU.

Israel

Israel is a pioneer in stem cell research, with the Ministry of Health ensuring strict oversight of these therapies.

Israeli scientists played a pivotal role in developing CRISPR gene-editing technology, which can help create universal treatments without the risk of immune rejection.

Wow-Fact: Israeli researchers were the first to create beating heart cells and a model of a human embryo with stem cells. These breakthroughs hold enormous potential for regenerative medicine, genetic research, and understanding congenital disorders.

In the Netherlands, research and treatments are regulated by the Dutch Healthcare Inspectorate and the Dutch Central Committee on Research Involving Human Subjects (CCMO). They allow only treatments that are proven safe. Therapies are closely monitored under clinical trial conditions. Most recently, the Dutch government approved treatment for multiple sclerosis (MS).

The country has a robust scientific community actively involved in research. In 2022, researchers from Leiden University Medical Center (LUMC) successfully used gene therapy to treat a baby with severe combined immunodeficiency (SCID)—the first successful case of its kind in history.

Switzerland

In Switzerland, these therapies are tightly regulated by Swissmedic, the national regulatory body for therapeutic products. Treatments must comply with the Transplantation Act and the Therapeutic Products Act.

Clinics offering these treatments in Switzerland must hold an establishment license from Swissmedic. It ensures strict adherence to legal and medical standards.

Many thanks to the interpreter Svetlana, with her help I was able to communicate with the doctor Andrzej Komor. Ice was one of the nurses who collected me from the airport. She was so kind for waiting nearly two hours for me due to a delay I had. She helped me so much after my surgery too. Another nurse Marge was wonderful. She helped with translation and my aftercare, she was so gentle when helping take out my stitches. I thank all of the nursing staff, they were all wonderful in their own way and treated me very well. I wish I could have spoken with the doctor more, he always seemed in a rush, I know he is a very busy man but if he could slow down just a bit it would help the patient care factor improve. But overall I'm really happy with my experience with the ID Clinic team ☺️ I only took two pictures of the inside of my overnight room, the clinic was very clean and comfortable and beautiful 🙏

I would like to share my experience with BookiMed and their recommmendation, VG (Very Good) Plastic Surgery. Doctor: Dr. Im Young Min Procedures: Deep plane facelift, mid-face lift with fat graft, sub-brow lift, lower blepharoplasty Referral: I had been wanting to get this surgery for quite a long time, but didn't know which clinic would be best, so I applied to Bookimed who gave me several quotes/recommendations based on my needs. I liked the procedures suggested by VG Plastic Surgery the best and I saw that they had good reviews online, so I set up a consultation. Consultation: At the consultation, several photos were taken in order to analyze the surgery and what would work best for me. The doctor suggested a sub-brow lift for my sagging eyelid skin, a deep plane facelift and a midface lift to address the loss of volume and sagging along with a fat graft to restore the volume to my cheeks, and a lower blepharoplasty to address the hollowness under my eyes along with the malar edema. I worked with Smile, one of the consultants who was very helpful and went over everything with me including all of the options and prices. She was very professional but warm, which is one reason that I decided to go with VG over other clinics. Pre-Surgery Check-up: A few days before my surgery, I went in for a checkup where they did a chest x-ray and a blood test to make sure my body was healthy enough for the surgery. I met with Dr. Im, my surgeon, to go over the plan for the surgery and make sure everything was in place. I met another consultant, Lily, who interpreted everything for me and made sure that everything was clear and comfortable for me. Surgery: The day of surgery, I did an interview about the procedure and how I was feeling prior to the surgery as well as taking several "before" photos to use as comparison. I had also fasted for 8 hours (food and water). The surgery was very smooth, but I believe it lasted a long time- between 6-8 hours as there were many procedures being done. I had to have a breathing tube, which was quite uncomfortable for the first 12 hours after surgery, but I was glad that the doctors took every precaution. They also put in drains in my neck and inside my mouth to keep blood and fluid from pooling under my skin as well as a catheter. Post-Surgery: After surgery, I was taken to a private room for recovery. I stayed in the room for about 24 hours and the nurses took very good care of me, coming in to replace the ice packs for my face, check on my catheter and incisions and just making sure I was comfortable. I was eventually able to have water, then some soy milk, and finally some porridge when I was ready. Lily and Smile checked on me several times to be sure everything was alright and to translate for me. The next day before leaving the hospital, the bandages were removed and Dr. Im came in and checked on me to make sure that everything had gone well. Lily, Smile and another consultant, Jenny, were there to interpret and to make sure I was alright. They removed the catheter and cleaned the incisions, replacing them with clean bandages. I also did an oxygen treatment in a hyperbaric chamber, which was very relaxing. I took a taxi home with Smile's support. Scary Moment: One thing that happened that was a bit scary for me was that I wasn't prepared for how much my eyes would swell up after the surgery. I felt like my bandages were bursting (and the nurse helped me to relieve some of the pressure) and when I looked at myself the day after the surgery, I wasn't prepared for what I saw. The veins in my eyes burst, making them completely red and my eyes swelled up so much I could barely see. This was scary for me as I had not seen this in any of the videos I had watched prior when doing my research. The staff assured me it was normal and that it would go back down, but I guess I'd say that for the first 2-3 days after the surgery, I was pretty worried that something was wrong. The ointment I was applying to keep the incisions clean also coated my eyes from time to time blurring my vision, which was scary, but the consultant assured me this was only because of the medication. I went back to the clinic after 3 days for a check-up and to have my incisions cleaned and the blood drains emptied. Each time I visited the clinic, I was given an oxygen treatment and several photos were taken for documentation. After the swelling in my eyes went down, my recovery progressed quickly. I had more visits (at 7 days, 10 days, 14 days and then 3 weeks) to remove stitches and drains and to monitor my progress. At 7 days, I was given a complimentary hair wash as well, which was very relaxing and such a relief. I also wore a head brace/wrap to keep my face from moving around too much for about a month. I did take it off to sleep at times because it felt tight, but I tried to keep it on during the day for the most part. Conclusion: I am now 5 months post-op, and I am very happy with my results. I feel that my concerns were addressed, and that I look younger and fresher, but still like myself, which was always the goal of this surgery for me. I feel a renewed vigor and like I look like the person I have always been, if that makes sense. I still have some puffiness under my eyes at times, especially when I have built up fluid retention or am very tired, and I am still working to find the cause/solution for this. I believe it is related to lymphatic drainage, so I understand that the surgery could not fully correct this issue, although I do feel like it is better than before. Most of all, I just wanted to say that I recommend VG because of the wonderful consideration, kindness, and support that I received there. From the way that the consultants went out of their way to help and support me, not just through translation, but by encouraging me and helping me, to the care the nurses gave me, to the skill that Dr. Im and his staff in the operating room showed, I am very happy. The scars from my incisions are unnoticeable and will most likely become completely invisible with time, and I feel that my surgery goals were reached. A big thanks to VG Surgery and their staff. I would also like to thank Bookimed for helping me to find this clinic and giving me the information I needed to make my decision.

Safety Profile and Complication Rates

Stem cell therapy demonstrates a generally favorable safety profile when performed by qualified medical professionals. According to comprehensive clinical analyses, adverse events occur in approximately 12% of mesenchymal stem cell treatments, with most being mild to moderate in severity.

Common Side Effects by Condition

  • Fever: 22% of patients in COVID-19 treatment, 9.8% in Crohn's disease therapy, 85% in multiple sclerosis treatment
  • Mild pain and swelling at injection site: reported in most patients within first 48 hours
  • Temporary inflammation: expected as part of the healing process

Serious Complications

Serious adverse events remain rare, with no treatment-related deaths reported in major clinical studies. However, potential risks include:

  • Infection risk: less than 1% when proper sterile protocols are followed
  • Immune reactions: more common with allogeneic (donor) cells
  • Tumor formation: theoretical risk, primarily with pluripotent stem cells (not used in most clinical applications)

Long-term follow-up studies averaging 14.16 months show no significant correlation between adverse events and treatment duration, with MRI scans revealing no harmful tissue changes post-treatment. Recent comprehensive research reveals stem cell therapy achieving a 78% overall success rate, with blood cancers showing 60–70% success rates and joint repair achieving approximately 80% positive outcomes.

Protecting Yourself: Ethical and Safety Considerations for Patients

Regenerative medicine is still a developing field, so it's essential to be extra cautious and well-informed. Here are some critical points to keep in mind when considering treatment:

1. Consider ethical implications

Not all types of stem cells are viewed the same in terms of ethics. One of the most debated areas is the use of stem cells from human embryos, typically left over from in vitro fertilization (IVF) treatments. Since obtaining these cells destroys the embryo, this raises ethical concerns.

On the other hand, some argue that since these embryos would otherwise be discarded, using them for medical purposes serves the greater good. You need to decide where you stand on this issue and be aware of what stem cells your treatment will involve.

If you're uncomfortable with embryonic stem cells, an alternative to consider is induced pluripotent stem cells (iPSCs). These adult stem cells have been genetically reprogrammed to behave like embryonic stem cells. They offer similar benefits without the ethical issues.

2. Consult a licensed medical professional first

Always consult a licensed and qualified doctor before considering any treatment. If you're unsure where to start, Bookimed can connect you with reputable specialists and clinics worldwide for a free consultation.

3. Understand the regulations in the chosen country

Various countries have different regulations surrounding these therapies. Make sure the country you're considering has a strong regulatory framework in place to protect patients and ensure treatments are scientifically validated. The International Society for Stem Cell Research (ISSCR) 2021 guidelines require substantial evidence of effectiveness in appropriately powered, well-controlled clinical trials with statistically significant findings before stem cell products can be marketed.

4. Ensure scientific validation

Make sure the therapy for your condition is backed by peer-reviewed research and has been validated in clinical trials. You can check clinical trial data on platforms like ClinicalTrials.gov or search for published research on sites like PubMed. These platforms provide data on ongoing and completed research.

5. Beware of misleading claims

Be cautious of clinics promising miracle cures or claiming treatments for unapproved uses. These therapies are still experimental treatments for many conditions, so verify whether the therapy is part of a legitimate clinical trial or simply unproven.

6. Understand potential complications

Although clinical trials indicate the relative safety of these treatments, there can still be side effects depending on the type of stem cells and the treated condition. Ask your doctor about the short- and long-term risks of the specific treatment you are considering.

7. Don't rush your decision—consider all alternatives

Take your time to evaluate whether this therapy is the best course of action for you. Be cautious of any pressure to make quick decisions or commit to immediate treatment without exploring other options.

How to Choose a Reliable and Safe Stem Cell Clinic

Guide to finding reliable stem cell clinics with proper credentials

With various clinics and treatments available worldwide, here are key steps to help you make informed decisions about your health:

1. Research the clinic's credentials and certifications for stem cell therapy

Ensure that the clinic complies with regulatory standards in the country, such as those set by the FDA in the U.S. or equivalent organizations elsewhere. Accredited clinics provide scientifically backed, safe treatments.

2. Verify safety protocols

Make sure the clinic follows strict safety protocols for handling, processing, and administering stem cells. Compliance with guidelines reduces risks such as contamination or infections.

3. Read reviews and patient testimonials

Investigate reviews from past patients and ask the clinic's representatives for success stories. A clinic with a solid reputation will have a history of positive patient experiences that can provide you with a clearer picture of its reliability.

4. Check for informed consent procedures

A reputable healthcare provider will fully inform you about the risks, benefits, and alternative treatments before undergoing therapy. You should never feel rushed into a decision. Avoid clinics that skim over the risks or pressure you to sign paperwork without proper consultation.

5. Ask about post-treatment monitoring and follow-up care

Ethical providers will offer ongoing care after the procedure to monitor for potential side effects or complications. This reflects a commitment to patient well-being beyond just the treatment itself.

6. Look for transparency in pricing and treatment plans

Reliable clinics are upfront about the costs involved. They should offer clear, detailed treatment plans after evaluating your case. There should be no hidden fees or surprise charges after you begin treatment.

7. Avoid clinics that promise miraculous results

Be cautious of language that promises complete recovery or miracle cures without scientific evidence. Reputable providers set realistic expectations and make it clear that results may vary.

If you're unsure where to start, Bookimed can help you navigate the emerging field of regenerative medicine with confidence. Just leave a request, and a personal medical coordinator will listen to your needs and concerns, helping you find the best clinic for your condition.
